This is a proceeding in habeas corpus in which the petitioner, Vincent Matthews, seeks to be discharged from the custody-of C. P. Burford, warden of the State Penitentiary. The said custody, as the record discloses, is based upon the facts that the petitioner was charged on January 10, 1931, with the crime of robbery with firearms of J. C. Butler; tried and convicted on January 21, 1931, and sentenced on January 23, 1931, to 50 years in the penitentiary. In the robbery, Butler was shot by the petitioner.
