This action was instituted by the appellee, Arthur L. Stage, as executor of the last will and testament of Mary E. McClarnon, deceased, to obtain an order for the sale of real estate for the purpose of procuring funds with which to pay certain bequests, debts and the costs of administration of the estate. The appellants were all made defendants to the action as the heirs, beneficiaries and personal representatives of Daniel G. McClarnon, the surviving husband of the testatrix who was named as the residuary legatee in her last will and testament and who died subsequent to her death.
