1Opinion of the CourtEwbank, J.
Appellee sued to quiet her title to certain lands as against a mortgage held by appellant. Answers were filed, but appellant did not file any cross-complaint for affirmative relief. The action was com*649menced at the February term of court, 1919. The court made a special finding of facts, on which it stated conclusions of law, and entered a decree in favor of the appellee, quieting her title, as prayed. Appellant excepted to the conclusions of law, and has assigned error thereon.
