Brokers, Inc. v. High Point City Board of Education
Court of Appeals of North Carolina
1Opinion of the Court
PARKER, Judge.
The only question presented is whether the trial court erred in granting judgment for defendant notwithstanding the verdict returned by the jury for plaintiff. We find no error.
When passing on a motion for judgment notwithstanding the verdict, the same standards applicable to a motion for directed verdict are to be applied. Thus, the court must consider the evidence in the light most favorable to the plaintiff and may grant the motion only if, as a matter of law, the evidence is insufficient to support á verdict for plaintiff.
