This appeal arises from the alleged breaches of duties owed by all parties under a contract for the extension of an existing landfill (“the landfill” or “the project”) site in the White Oak section of Haywood County. The extension was to create a new landfill cell, approximately ten acres in surface area, to meet the County’s solid waste disposal needs.
