Before the Court is defendant’s motion to dismiss or for summary judgment on plaintiff’s three-count complaint. The complaint, filed in state court on May 23, 1985, and removed to this court July 5, 1985, concerns a business relationship between the parties for the purpose of operating a service station [“gas dispensing Ride through Tunnel Car Wash”] in Independence, Missouri.
