This is a replevin suit brought before a magistrate, where a judgment went for the plaintiff. On appeal to the Circuit Court, where the case was tried before the Judge without a jury on a stipulation of facts, the suit was dismissed on the ground that the writ of replevin issued in the Magistrate’s Court in commencement of the action had been prepared by one not duly licensed and qualified to practice law, and was, therefore, null, void and of no effect.
