Appellant, James Hardie Gypsum, Inc. (“Hardie”), entered into an oral rental agreement with Inquipco for a boom crane truck. Thereafter, the truck was damaged while being operated by a Hardie employee.

Inquipco sued Hardie for loss of rental income, moving expenses, investigation charges and attorney’s fees. The district court, sitting without a jury, entered judgment for Inquipco. Hardie appealed, contending that the trial court erred in finding that the parties entered into an oral agreement with a written modification.
