This cause was originally commenced in equity. The petition was filed February 17, 1911. The cause of action was stated in four counts.
The first count alleged that the plaintiff verbally employed the defendant to negotiate with one Treloar for the purchase of the premises in controversy for and in behalf of himself and the defendant, each to pay one-half of the pur*133chase price; that the defendant purchased the premises, and the plaintiff was ready, able, and willing to pay one-half of the purchase price; that the defendant refused to recognize the plaintiff’s rights therein.
