Appeal from, Adams District Gourt,— Hon. W. E. Miller, Judge. Suit for the surrender and cancellation of a certain bond and mortgage. The petition was dismissed, and plaintiff appeals.—

— • One J. H. Bamsey executed to the defend ant O. E. Erskine a bond for the payment of $1,800, dated February 1, 1899, payable in five years, with interest at the rate of 5 per cent, per annum, evidenced by coupons attached to the bond, and secured by a mortgage on one hundred and twenty acres of land in Adams county. The bond and coupons were made payable at the Corning State Savings Bank at Corning, Iowa. In October, 1900, S. H. Manatrey, as owner of this land executed a contract of sale thereof to the plaintiff, in which the latter expressly assumed and agreed to pay the above…
