BISHOP, J.
The respondent commissioner of correction appeals from the judgment of the habeas court granting the amended petition for a writ of habeas corpus that was filed by the petitioner, Thomas Sanders. The respondent claims that the court improperly (1) considered a claim that was not raised in the petition, (2) concluded that the petitioner’s trial counsel was ineffective for failing to advise the petitioner properly of a plea offer from the state at the petitioner’s underlying criminal trial and (3) concluded that the petitioner was prejudiced by counsel’s deficient performance.…
