Appeal by the plaintiff, Sarah Watkins, from a judgment of the Supreme Court in favor of the defendant, entered in the office of the clerk of the county of New York on the 27th day of January, 1921, upon the decision of the court rendered after a trial at the New York Special Term.

This is an action for the annulment of a marriage between the plaintiff and the defendant on the ground of fraud. The summons was duly served on the defendant, who duly filed *490a notice of appearance by attorney but defaulted in answering and failed to appear on the trial. On the 14th of November, 1918, plaintiff, who resided in the borough of Manhattan, New York, and was eighteen years of age, was requested by the defendant to marry him and she refused to consent excepting upon condition that the marriage ceremony should be performed according to the Jewish religion and rites and…
