This is an appeal from the district court of Muskogee county, and the plaintiff in error was defendant and defendant in error was plaintiff in the court below, and for convenience will be referred to here as they were there. The plaintiff brought suit against the defendant for damages which he claimed he was entitled to by reason of the fraud and deceit practiced on him by the defendant’s false representations, causing him to execute a written contract and his notes for $15,000, in the purchase of a half interest in a lumber company in Muskogee county, Okla., with the…
