OPINION OF THE COURT ON RECONSIDERATION

WATKINS, Senior Judge:

On the night of 9-10 September 1984, an eighteen-year-old German girl accepted a ride home from a discotheque with an American soldier whom she knew as the boyfriend of one of her girlfriends. This soldier was himself a passenger in an automobile occupied by three of his male friends, all of whom were members of the armed forces of the United States stationed in the Federal Republic of Germany.1 The girl, who was of chaste character, was not driven directly to her home as she had anticipated.
