Defendant appeals from a judgment of tbe district court for Pawnee connty, in a trial bad in that court on an appeal by tbe 'defendant from tbe action of tbe board of *3supervisors of plaintiff, fixing the amount of special benefits accruing to the defendant from the operations of plaintiff in providing new channels and straightening the Nemaha river and linn creek, in Pawnee county. The several assignments of error presented and argued in defendant’s brief will be considered in the order in which they appear therein.
