VALLÉE, J.

Appeal by plaintiff from two judgments for defendant in an action of claim and delivery. The controversy centers around the title and the consequent right to possession of some two hundred thousand Christmas greeting cards.

Plaintiff maintains a division known as California Artists which publishes and distributes Christmas greeting cards. Each year it publishes a series of new cards in albums. The albums are distributed to its retail outlets. Cards carried over from one season are boxed for the next season and sold at a lower price. After two seasons the remaining cards are reviewed…
