REYNOLDSON, Chief Justice.

In this medical malpractice case plaintiff Gary R. Cowman appeals from a summary judgment for defendant William R. Horna-day, Jr. We reverse and remand.

Plaintiff’s petition alleged that on September 29, 1976, defendant performed a contraceptive bilateral vasectomy upon him.
