LAY, Chief Judge.
Robert L. Petty filed suit against the United States for compensatory damages under the Swine Flu Act, 42 U.S.C. § 247b(j)-(Z) (1976), in conjunction with the Federal Tort Claims Act, 28 U.S.C. §§ 1346(b), 2671-80. The district court, the Honorable Donald E. O’Brien presiding, found the United States liable under negligence and strict liability theories. Petty was awarded $212,802.22 in damages. Petty v. United States, 536 F.Supp. 860 (N.D. Iowa 1980). The judgment was vacated on appeal and the case remanded to the district court with directions to make express determinations…
