DURHAM, Chief Justice:

¶ 1 This case concerns a mechanic’s lien and suit for breach of contract brought by petitioner J. Pochynok Company (Pochynok) against respondents Gregory and LouAnn Smedsrud (the Smedsruds), who counterclaimed for breach of contract. We granted certiorari to consider (1) whether the court of appeals erred in upholding the trial court’s determination that the Smedsruds were the “successful party” under Utah Code section 38-1-18(1) when the jury returned only a general verdict that did not indicate which party prevailed on which claims, and (2) whether Pochynok’s potential…
