This matter is before the Court pursuant to Defendants’ Motion to Dismiss, FED.R. CIV.P. 12(b)(1), (b)(2), (b)(3), (b)(5) and (b)(6), or for Summary Judgment. FED.R. CIV.P. 56.

I. Statement of Facts

Plaintiff is a sentenced prisoner and a national of Cuba who is currently detained in the Federal Correctional Institution (FCI) in La Tuna, Texas.
