Plaintiff appeals from two separate judgments of dismissal. The first of said judgments was entered in favor of defendant Indemnity Insurance Company of North America following the granting of said defendant’s motion to strike the third amended complaint as to said defendant. The second of the said judgments was entered in favor of defendant American Surety Company of New York after the sustaining of said defendant’s demurrer to the fourth amended complaint without leave to amend.
