This cause was tried upon the following agreed statement of facts:

“It is hereby stipulated and agreed between the parties hereto that the city of Enid is a city of the first class under the laws of the then territory, now state of Oklahoma; that the defendant, the Enid City Railway Company, was incorporated under the laws of the then territory of Oklahoma on the-day of February, 1907, and that articles of incorporation were filed and a charter issued by the proper authorities of the then territory of Oklahoma, under and by virtue of article 4 of chapter 9 of Session Laws of 1903, and that on…
