Pursuant to the provisions of section 19 of the Banking Law (Consol. Laws, chap. 2 [Laws of 1909, chap. 10], as amd. by Laws of 1910, chap. 452), appellant Van Tuyl, as Superintendent of Banks of the State of'Hew York, took possession of the assets and property of the Carnegie Trust Company on the 7th day of January, 1911, and has ever since been in charge thereof liquidating the same. Thereafter and prior, to the 15th day of April, 1911, the nineteenth Ward Bank filed with him proof of two claims against the Carnegie Trust Company for $2,066 and $20,439.98 respectively, and…
