— Judgment unanimously reversed, on the law, and as a matter of discretion in the interest of justice, defendant’s motion to suppress granted, and defendant remanded to Supreme Court, Erie County, for further proceedings on the indictment. Memorandum: Defendant’s motion to suppress his confession should have been granted (CPL 60.45 [2] [b] [ii]; Bram v United States, 168 US 532).
