Judgment unanimously reversed on the law, plea vacated, defendant’s motion to suppress granted, and defendant remanded to Supreme Court, Onondaga County, for further proceedings on the indictment. Memorandum: In the course of a police surveillance aimed at a rash of burglaries in DeWitt, New York, defendant was arrested and charged with burglary. With him in a car were his wife and young son. Defendant’s wife was IVz months pregnant.
