Before the Court is the request of the above Chapter 11 Debtor, Curtis Center Limited Partnership (the “Debtor”), for approval of its second amended disclosure statement relating to the Debtor’s second amended plan of reorganization. Approval of the Debtor’s second amended disclosure statement is vigorously opposed by the Debt- or’s principal secured creditor, the Sumitomo Trust & Banking Co., Ltd., New York Branch (“Sumitomo”), which maintains that the Debtor’s second amended plan of reorganization is patently unconfirmable.
