*652In an action to recover damages for breach of contract and on an account stated, the defendant appeals, as limited by his brief, from so much of an order of the Supreme Court, Kings County (Harkavy, J.), dated March 28, 2007, as granted those branches of the plaintiffs motion which were for summary judgment on the cause of action to recover damages for breach of contract and to dismiss his counterclaim.
Ordered that the order is affirmed insofar as appealed from, with costs.
