Appeal by the trust company from an order overruling its demurrer to the complaint, on the sole ground that it does not state facts sufficient to constitute a cause of action.
The here material allegations of the complaint are: That the plaintiff is the receiver of the City Bank, a corporation duly organized, and that the defendant trust company is, and has been for the past five years, a corporation duly organized under the laws of the state of Minnesota.
