Robert P. Pinkney, whose administratrix is plaintiff in this case, died as the result of an injury received in the course of his employment by defendant, a common carrier of both interstate and intrastate commerce. She brought suit under the Federal Employers’ Liability Acts of April 22, 1908, and April 5, 1910, alleging the injury occurred while he was engaged in interstate commerce, and the only defense to the action was that he was then engaged in intrastate commerce.
