Anstine, the plaintiff, was injured by the joint or concurrent negligence- of Davis and the Pennsylvania Railroad Company, and in his suit against them, recovered a verdict of $20,000. The railroad company moved for a new trial and for judgment n. o. v. Davis, the other defendant, took no action with respect to the verdict, whereupon plaintiff caused judgment to be entered against Davis in the sum of $20,000.
