On November 21, 1932, plaintiff was struck by an automobile driven by one Taylor, and suffered injuries of which the most serious was a fracture of the neck of the right femur. He was taken immediately to the private hospital of defendant, a practicing physician, and remained under his care until May, 1933. In October, 1933, he brought an action against Taylor in the Dis trict Court of tlie United States for the District of New Jersey, his statement of claim alleging that the accident occurred by reason of Taylor’s negligence in the operation of the automobile,…
