I. FACTUAL BACKGROUND
KEEP, District Judge.
On September 23,1983, plaintiff Timothy Keller was arrested in his home in the presence of plaintiffs Maxine Keller, his wife, and Kathy Dockter, his stepdaughter. Pursuant to an indictment, a Timothy Keller (not the plaintiff herein) was charged with conspiracy to possess marijuana with intent to distribute, possession of marijuana with intent to distribute, conspiracy to travel in interstate commerce in aid of racketeering activities, and conspiracy to illegally transport U.S. currency out of the United States.
