I. INTRODUCTION

This cause is before the court on Defendant Cross Country Bank’s (“Cross Country”) Renewed Emergency Motion to Enforce Compliance with the Court’s November 26, 2003 Order (Doc. #47), Mo tion to Enjoin (Doc. # 51), and Revised Motion to Enjoin Plaintiff from Pursuing a Class Action Claim in Arbitration (Doc. # 56). The court held oral argument on the motions on January 6, 2005.
