OPINION
KLINGEMAN, Justice.
This is a suit for a partition brought by a number of cotenants of a 70-acre tract of land against Victor Hernandez, Jr. Victor Hernandez, Jr., filed a cross-action in the nature of trespass to try title asserting that he is the owner of the 70-acre tract under the 10-year statute of limitations. All parties are descendants of Victor Hernandez, Sr., and wife, Marta, and claim their title through Victor Hernandez, Sr. Victor Hernandez, Jr., died during the pendency of this suit and his son, Jose C.
