Appeal from a judgment of the Supreme Court (Lamont, J.), rendered April 9, 2004 in Albany County, upon a verdict convicting defendant of the crime of criminal sale of a controlled substance in the second degree.

In July 2003, the Drug Enforcement Agency (hereinafter DEA) set up a controlled buy between defendant and a confidential informant. In preparation for the buy, the DEA recorded a telephone conversation between the confidential informant and defendant wherein the two agreed to meet at defendant’s residence in the City of Albany.
