Appeal from a judgment of the County Court of Sullivan County (Hanofee, J.), rendered September 7, 1989, upon a verdict convicting defendant of the crimes of rape in the first degree and sexual abuse in the first degree.

Defendant was indicted on charges of rape in the first degree, sexual abuse in the first degree and assault in the second degree. Following a jury trial, defendant was convicted of the rape and sexual abuse charges and acquitted of the assault charge.
