Appeal from a judgment of the County Court of Columbia County (Czajka, J.), rendered September 8, 2004, upon a verdict convicting defendant of the crimes of assault in the second degree and assault in the third degree.

Defendant and his girlfriend (hereinafter the victim) had a dispute while at a Halloween party.
