This is an action by William J. Best and wife, for the rescission, for fraudulent misrepresentation, of a contract of sale whereby plaintiffs agreed to purchase, and the defendants J. W. Offield and wife agreed to sell, a certain orchard and land in Garfield county, Washington; the-plaintiffs seeking to recover the amount of the purchase money already paid, together with expenses incurred in connection with the purchase and expenditures made upon the land while they were in possession.
