This is yet another one of the many § 1981 employment discrimination cases that must be completely re-evaluated in light of the Supreme Court’s intervening decision in Patterson v. McLean Credit Union, — U.S. —, 109 S.Ct. 2363, 105 L.Ed.2d 132 (1989). Suing in their individual capacities and on behalf of a class of similarly-situated persons, 1 the seven black plaintiffs allege that the defendant engaged in “a pattern or practice” of intentional race discrimination in hiring and internal employment matters in violation of § 1981.
