This action was filed in the district court of Tulsa county by the,plaintiff in; error, D. R. MacInnis, plaintiff below, against the defendant in -irror, G. A. Perram, defendant below, and for convenience the parties will be designated as they appeared in the trial court.

The plaintiff first filed an instrument entitled “Affidavit” which he afterwards change ed to “Petition” and inserted plaintiffs’ and defendants’ names, also inserting in next to the last paragraph, the words “and that the plaintiff is without' adequate remedy at law and may be irreparably damaged unless…
