The appellant, as the holder.of an overdue promissory note made by Samuel J. and Carrie L. Windsor to the order of the appellee and by him endorsed, brought separate suits thereon against its endorser and makers and obtained a judgment in his favor for a like amount in each case. The appellee, as the endorser of the note, thereupon tendered to the appellant the full amount of the judgment against the makers asking at the same time for an assignment to him of that judg ment. The appellant refused to assign the judgment as requested hut offered to enter it satisfied.
