MEMORANDUM AND ORDER
CROW, District Judge.
The case comes before the court on the defendants’ motion to dismiss. (Dk. 5). The plaintiff is a Citizen Band Potawatomi Indian. She is the owner and operator of the “Indian Country General Store” located on the Prairie Band of Potawatomi Indian (“Prairie Band”) Reservation in Jackson County, Kansas. The plaintiff also resides on the Prairie Band Reservation. The defendants are the six members of the Tribal Council of the Prairie Band.
