DECISION AND ORDER

ARCARA, District Judge.

INTRODUCTION

This is an action for declaratory and in-junctive relief, pursuant to 42 U.S.C. § 1983, brought by Dennis J. Bowen, Sr. (“Bowen”), in both his individual capacity and in his capacity as the President of the Seneca Nation of Indians (the “Nation”), to enjoin Justices Vincent E. Doyle, Jr. and Penny M.
