This cause is before the Court on the following motions: (X) Motion to Dismiss Complaint filed by Boyd Mississippi, Inc. (“Boyd”), and (2) Motion of the Mississippi Band of Choctaw Indians (“the Tribe”) for Leave to File Brief Amicus Curiae. Having considered the Motion to Dismiss, Plaintiffs Response, Defendant’s Rebuttal and supporting and opposing memoranda, the Court finds that the Motion to Dismiss is not well taken and should be denied.
