KLEIN, Justice.
In this declaratory judgment action, the Maui County Council (“council”) appeals the dismissal by summary judgment of its suit alleging that Travis Thompson, in his official capacity as Director of Finance, County of Maui, Guy Haywood, in his official capacity as Corporation Counsel, County of Maui, and Linda Crockett Lingle, in her official capacity as Mayor of the County of Maui (collectively, “defendants”) violated the Maui County Charter (“charter”).
