ORDER
DOTY, District Judge.
This matter is before the court on the cross-motions of the parties for summary judgment. Based on a review of the file, record, and proceedings herein, and for the reasons stated, the court grants defendants’ motions and denies plaintiffs motion.
BACKGROUND
Plaintiff Thomas A. Schmitz (“Schmitz”) hired defendant Home Town Mortgage, Inc. (“Home Town”) to obtain financing for a residential home loan.
