Introduction

This matter comes before the Court on cross motions for summary judgment. Plaintiffs Mark Gardner and Danielle Baker (collectively, “Plaintiffs”) have brought this action alleging that Defendants First American Title Insurance Company, Universal Title Company, and Universal Partnerships, Inc. (collectively, “Defendants”), have violated the Real Estate Settlement Procedures Act’s (RESPA) prohibition against kickbacks and referral fees.
