Pécora, J.
On May 22, 1940, while respondent and petitioner were members of the New York Stock Exchange, the arbitration committee of said exchange rendered an award aga'nst respondent in the sum of $50,000, plus interest and costs. A motion was made .in this court to confirm the award, and, upon default by respondent, *278the award was confirmed and a judgment was entered on June 14, 1940, in favor of petitioner for the sum of $57,392.48.
