GARDNER, Circuit Judge. .
Appellee, as plaintiff, brought this action against appellant to recover damages for loss of property by fire, which it is alleged was within the coverage of an insurance policy issued by appellant. It will be convenient to refer to the parties as they were designated in the lower court.
Plaintiff was, at all times pertinent to this action, a common carrier of freight by truck, and the policy issued by the defendant was by its express terms in compliance with the provisions of the Iowa Code (Section 5105a-26), requiring such carrier to file with the Board of Railroad…
