GARDNER, Circuit Judge.
This is an appeal from a judgment entered against the Ocean Accident and Guarantee Corporation, Limited, defendant below, in favor of appellee Penick & Ford, Ltd., Incorporated, plaintiff below. We shall refer to the parties as they appeared below.
Plaintiff brought the action to recover upon a policy of machinery insurance issued by defendant, whereby it agreed to indemnify plaintiff against loss 'to certain specified machinery resulting from its ac cidental breakdown, as defined in the policy.
